Terms & Conditions of Sale and Privacy Policy

By purchasing a cake / cupcake / bouquet from Tickled Fancies online shop it is assumed that you have read and accepted these terms and conditions in full.
All prices are non-negotiable and priced according to your exact specifications of design and size of cake/cupcakes/bouquet.
All payments are taken in full at checkout.
All orders are made to order and are by default available for collection only from Tickled Fancies address. We only deliver for weddings or events. Please see below,
Any non-collected orders due to sickness or extreme circumstances are refundable only at Tickled Fancies' discretion. We reserve the right to refuse a refund of any order placed via this online shop should we deem it unreasonable or suitable to do so.
Deposits are only necessary for orders for weddings – this will be discussed individually and finalised at a consultation between us and the customer. Deposits are hereafter non-refundable.
In making an order you agree that you are making a reservation for our artist’s time for the manufacture of a bespoke product(s) as you have described in your order. As such, we will begin to act on your instructions immediately where your selected date is less than three weeks from the purchase date; or on the day three weeks prior to your selected delivery day. Once your order has commenced, the cancellation fee is 100% of the order value.
Once an order is placed, adjustments and alterations may only be made at the discretion of Tickled Fancies on an individual basis. We reserve the right to refuse any adjustments and alterations after an order is finalised.
Collection times are selected via an online calendar by the customer. Once you have selected your preferred collection time it is your responsibility to adhere to the chosen time and date. Any rescheduled collection times will be solely at our discretion and cannot be guaranteed under any circumstances.
Your cakes are baked to ensure they are fresh for the date of collection, we cannot guarantee quality if consumed more than 48-72 hours after collection. Cakes are made entirely of natural ingredients, so they do not have the extended shelf life of most supermarket cakes, which contain additives and preservatives to ensure their prolonged life.
Your cakes need to be kept at room temperature in a cool dry room out of direct sunlight and must not be refrigerated as this can alter the flavour and texture of the product. Tickled Fancies will not be held liable if items are not consumed during the recommended time frame or are stored in an incorrect manner. It is the purchaser’s responsibility to ensure the storage conditions are adhered to.
Due to the perishable nature of these products we do not recommend keeping longer than three days. There are no refunds available on any perishable item.
All ingredients are of the highest quality and freshly prepared without the use of any preservatives. Product ingredients can include eggs, flour, cocoa, sugar, milk, margarine and butter. Note: if a colour other than natural buttercream is requested there will be food colour additives in the buttercream. If you require more information about colour additives when considering placing an order please contact us to discuss.
We do not cater for any specific dietary requirements such as allergies and take no responsibility for any consequence of such.
Due to the nature of these products there will be variation in the product in comparison to any other product depicted in our gallery. We do not and cannot guarantee 100% accuracy in design or manufacture and whilst we make every effort to provide the product requested, you accept there will likely be variance in colours and design in your order from gallery pictures.
Customer design specifications are available via drop down, buttons and text areas in selections within the online shop. Final designs and variants thereof are at the final discretion of Tickled Fancies to ensure the best possible result for each individual customer.
Where cakes are supplied as a collection, they contain different variants of design and colours. Final design specifications are at Tickled Fancies' discretion.
If you are in any way unhappy with your order please inform us promptly so that we can rectify any issues in a timely fashion. Refunds or replacements at our discretion cannot be issued without return of product.
Any damages incurred through the use of our service is limited to the cost of the product purchased and in purchasing from Tickled Fancies the buyer accepts and agrees to be bound by the terms and conditions described above.
Tickled Fancies reserve the right to use any image of a cake/cupcakes or workshop taken by Tickled Fancies for publication on social media and other publications.
The intellectual property rights in the Website, including copyrights, trademarks, trade names, patents, trade secrets, work methods and processes and any other right, are the sole property of Tickled Fancies, or of third parties by whom Tickled Fancies was licensed according to law. These rights apply, among others, to any textual and non-textual information, including images, graphic design, data and its processing, the Website’s computer code and any other detail concerning its operation.
You may not copy, duplicate, distribute, sell market and translate any information, including trademarks, images, pictures, texts without receiving Tickled Fancies permission in writing. Computer code and website design remain the property of the intellectual property holder(s) and their rights remain unchanged.
Trademarks appearing on the Website (whether registered or not), the name of Tickled Fancies and its trademarks as well as the Website’s Domain name – are the sole property of Tickled Fancies.

DELIVERY.

We will make every effort to deliver on your chosen day. We will call you prior to arrange delivery. Whilst we will where possible deliver within an agreed time window, note that deliveries can be between 9am and 8pm on the day. In the case of abandoned/cancelled delivery due to no one being available to accept delivery, redelivery can be made a full cost, or undelivered items can be collected next day from our premises. Where possible, we can deliver to a nominated neighbour.

You must be available by phone to arrange delivery; and to contact in the event there is an issue during delivery. Failure to do so may result in your delivery being cancelled.

Where by force-majeure on our part we are unable to deliver, we will let you know and the delivery cost will be refunded in full. If you ordered delivery with product in one single order, we will process a refund of the full amount, or if you prefer, offer the product for collection and refund delivery separately. If delivery is ordered separately, we will refund delivery only and your product will remain available for collection as agreed for that purchase.

We will not collect sensitive information about you without your specific consent.
Our web server collects your domain name and your e-mail address.

Your information will enable us to provide you with the services that you request and to process your order (including verifying payments). We may also use your personal information for market research and customer satisfaction purposes, and so that we can administer, support, improve and develop the services that we offer.
